0. Purpose
Welcome to fud.es (the "Site"), operated by Just Pet Food S.L. ("we", "our" or "the Company"). By accessing and using our Site and our services, you agree to comply with and be bound by the following Terms and Conditions of Use. Please read these conditions carefully before using our Site.
The following General Conditions govern the purchase of products and services available on the website fud.es, owned by Just Pet Food S.L.
The purchase of any product or service implies the full and unreserved acceptance of each and every one of these General Conditions, without prejudice to the Particular Conditions that may apply to certain products and services. These General Conditions may be modified without prior notice, so it is recommended that you read them carefully before making any purchase.

All notifications and communications between Users and FUD will be considered effective when made through the means indicated above.
3. Intellectual property
All content on the Website, including but not limited to text, graphics, logos, images and software, is the property of Just Pet Food S.L. or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify or create derivative works of such content without our prior written permission.
4. Acceptable use of the site
You agree to use the Website responsibly and in compliance with all applicable laws and regulations. You shall not:
Use the Website for any illegal purpose.
Interfere with the operation of the Website or the Company's servers.
Post or transmit any content that is offensive, defamatory, obscene or that infringes the rights of third parties.
5. Limitation of liability
To the maximum extent permitted by law, Just Pet Food S.L. will not be liable for any indirect, incidental, special or consequential damages arising out of or related to the use of the Site or our services.
6. Links to external sites
Our Website may contain links to third-party websites that are not operated by us. We have no control over the content and privacy practices of these sites and assume no responsibility for them.
7. Products and services
FUD offers dog food by subscription on its Website. We have five different menus, made with 100% natural ingredients and without preservatives. The menus, along with details about their preparation, ingredients, nutritional information and prices, are available on the website. FUD reserves the right to modify the offer of products and services at any time, being able to add new ones or remove existing ones without prior notice.
The acquisition of products and services will be made only through subscription or registration of the User. The User must create an account through the platform provided by FUD, which will allow access to the products and services. To contract the different products and services, the User must follow the instructions of the purchase process, which implies reading and accepting all the General and Particular Conditions established at fud.es.
To use our services, the User must register and create an account on the Site. The User is responsible for maintaining the confidentiality of their account and password, and for all activities that occur under their account. The User must provide truthful, accurate and complete information when registering.
8. Availability
FUD is not responsible for damages that Users may suffer due to failures or disconnections in telecommunications networks that may cause the suspension, cancellation or interruption of the service during its provision.
9. Purchase and/or contracting process
To make any purchase from FUD, the customer must be of legal age. In addition, the customer must register on FUD through a data collection form, providing the necessary information for contracting. This data must be truthful, accurate and complete regarding their identity, and the customer must give explicit consent by accepting FUD's privacy policy.
10. Process to make a purchase
Complete a brief form on the website with the requested information. This will allow our algorithm to determine the specific nutritional needs of your dog and create a personalised plan and prices. Once the form is completed, the most appropriate option will be applied individually to carry out the transition process with our TRANSITION menus.
To complete the purchase, enter the necessary data in the payment gateway.
Upon completing the payment, the monthly subscription contract (28 days) is formalised, which you can pause or cancel at any time without commitment.
The subscription begins with a 14-day trial and, after this period, will be automatically renewed every 28 days. Before the trial ends, you will receive an email or SMS notification informing you of the charge for the next month. In subsequent monthly payments, you will receive an email notification about the next month's charge.
11. Duration, renewal and cancellation of the contract
The contract between the User and FUD (the "Contract") is considered formalised once the User has completed the subscription process by filling in the form and confirming their subscription to the services. After confirmation of the subscription, FUD will send an email confirming receipt of the order and the delivery period (the "Shipping Confirmation"). Each delivery will receive a Shipping Confirmation. By placing an order, these General Conditions are accepted. The User must verify that the data provided and collected in the Shipping Confirmation are correct. FUD is not responsible for errors in the data provided by the User. The Contract covers only the Services specified in the Shipping Confirmation.
The User may pause or edit the renewal of their subscription from their User account or by contacting the customer service department through info@fud.es. By pausing the renewal, the User will not pay the next monthly fee or receive their next FUD box. The User can resume their FUD subscription by contacting the Customer Service Department.
The User can cancel their FUD subscription at any time or modify their payment method within the account created at FUD. This cancellation will take effect in the same month it is made, provided it is carried out before the charge corresponding to the next shipment. Otherwise, the cancellation will be effective the following month, affecting both the shipment of the box and its charge. FUD reserves the right not to make refunds if the cancellation of the subscription is not requested before the indicated date.
12. Delivery
PRODUCTS: the order will be dispatched to the address provided by the customer at the time of purchase, according to the selected modality. Delivery areas include: Spain (Peninsula only).
DELIVERY METHODS AND TIMES: deliveries on the Peninsula can receive their orders from Tuesday to Friday between 9:00 a.m. and 2:00 p.m.
13. Prices, fees and taxes
The prices of products and services offered by FUD are guaranteed during the validity period, regardless of the destination of the order.
Prices include VAT.
The VAT rate is 10%.
Shipping costs are free.
There are no additional costs.
The prices of products may change at any time. In such case, the applicable price will be the one in force on the date of the order. In any case, the final cost will be communicated to the customer during the purchase process before they accept it.
14. Payment methods
The purchase can be made by credit or debit card.
Payment by credit or debit card
Payment is made immediately through our bank's secure SSL payment gateway. If a return is necessary or the order is cancelled, the amount will be refunded to the same card used for the payment. Personal and bank data will be protected with all the security measures required by the company according to the European Data Protection Regulation and will be totally confidential.
15. Product warranty
FUD ensures that its menus are made with 100% natural ingredients and without preservatives. Packaging is carried out in a controlled atmosphere to ensure optimal conservation of the orders. The cooked products are kept refrigerated. The expiry date is indicated on the packaging. Once the orders are delivered, the customer must follow the conservation instructions to keep the product in good condition, as indicated in the welcome manual with the initial order. The food must be stored in the refrigerator or freezer.
16. Returns and withdrawal policy
According to current regulations, consumers and Users are informed of the right to return any product that has a defect or manufacturing flaw at no cost, except as provided in articles 107.2 and 108 of RD 1/2007, of 16 November, which approves the consolidated text of the General Law for the Defence of Consumers and Users. However, with respect to the products marketed by FUD, this right of withdrawal is governed by the exception established in Art. 103, paragraph d) of RD 1/2007, of 16 November.
The supply of goods that may deteriorate or expire quickly. The products delivered are cooked food for animals and have an expiry date, so they are exempt from the right of withdrawal. By contracting the service, the User accepts and agrees that, once the order has been received, they will not be able to exercise the right of withdrawal, which means that they will not be able to return them.
17. Liability and exemption from liability
Consumers and Users have the right to repair the product, replace it, reduce the price or terminate the contract, as established in Chapter II Title IV Book II of the General Law for the Defence of Consumers and Users. If the product does not comply with the contract, the consumer may choose between repair or replacement of the product, both free of charge, which will be carried out within a reasonable period of time according to the nature of the products and their purpose. If, after replacement and delivery of the product, it still does not comply with the contract, the consumer may demand its replacement, a price reduction or termination of the contract. Specific observations:
If the cause is attributable to FUD, such as breakage of the packaging during transport, loss or theft of any package during transport, or failure in the conservation of the package, FUD will replace the defective or missing bags from the order as soon as possible, provided the same product or another with similar characteristics is available and the customer has an address in Spain.
FUD is not responsible for the state of the order once delivered to the customer, if the customer has not followed the recommendations for product conservation in refrigeration and/or freezing and the defrosting process indicated by FUD on its Website.
FUD notifies the User in advance about the day of delivery; if an order cannot be delivered due to the User, FUD is not responsible for the state of the order or its resending. In this case, the User must pay 50% of the monthly fee.
FUD warns the User in advance about the day of subscription billing by email and/or SMS; once the charge has been made and the order processed, FUD is not responsible for refunding the amount.
FUD is not responsible for errors in addresses, postal codes, etc. If an order cannot be delivered correctly to the User due to errors in the address, the customer must pay 50% of the monthly fee.
FUD warns in advance so that the User can make changes to their subscription (dates, menus, dog's weight…) and is not responsible for adjustments not made correctly once the subscription has been charged. However, if the adjustment is possible, FUD will make it.
FUD may suspend, withdraw or cancel partially or totally the contracted services at any time and without prior notice. The above provision does not affect those services reserved for registered Users or that are subject to prior contracting and which are governed by their Specific Conditions.
18. Customer service and claims
To submit any complaint or claim before FUD · Comida cocinada para perros, the customer must contact the customer service department by email at info@fud.es. In addition, there is a chat available on the website to resolve doubts and queries.
To process the claims related to the incidents indicated in point 11, we ask the customer to take photos of the order in poor condition or whose packaging is broken or defective and send them to the Customer Service Department together with the written claim. According to the EU Online Dispute Resolution in consumer matters and pursuant to Art. 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform available at the following link: http://ec.europa.eu/consumers/odr/.
19. Applicable law
These Conditions shall be governed by current Spanish legislation. The language used will be Spanish. In the event of having to resort to the Courts to resolve any dispute between the parties, if the User is a consumer, the Courts and Tribunals of their domicile will have jurisdiction.
20. Changes to the terms and conditions of use
We reserve the right to modify these Terms and Conditions of Use at any time. We will publish any changes on this page and update the "Last updated" date at the bottom of these Conditions. By continuing to use the Website after the changes are published, you accept the new Conditions.
